01 Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the Match Vibe Fusion website, applications, and related features and services (collectively, the "Service"). In these Terms, "Match Vibe Fusion," "we," "us," and "our" refer to the operator of the Service.

By accessing or using the Service or creating an account, you acknowledge that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

These Terms do not waive rights that cannot lawfully be waived under applicable consumer protection laws.

02 Eligibility

You must be at least 18 years old to use Match Vibe Fusion. By using the Service, you represent that:

• You are at least 18 years old;
• You have the legal capacity to agree to these Terms;
• Your use of the Service is not prohibited by applicable law;
• You are not attempting to evade a prior suspension or termination; and
• You will comply with applicable laws and these Terms.

We may request information or take reasonable steps to verify age when appropriate. If we reasonably determine that an account belongs to someone under 18, we may restrict or terminate access and handle associated information in accordance with applicable law and our Privacy Policy.

03 Your account

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account, subject to applicable law. Use reasonable security precautions and contact us at contact@matchvibefusion.info if you believe your account has been accessed without authorization.

Your account is personal to you and may not be sold, transferred, or shared in a way that violates these Terms. Do not create another account to evade a suspension or termination.

You agree to provide information that is accurate and not misleading and to update it when reasonably necessary. Impersonating another person, misrepresenting your age, or using images without the necessary rights may result in account restrictions or termination.

04 Community conduct

You agree to use Match Vibe Fusion respectfully and lawfully. You must not:

• Harass, threaten, stalk, intimidate, exploit, or abuse another person;
• Post or share unlawful content, credible threats, or sexually exploitative content involving minors;
• Impersonate another person or materially misrepresent your identity, age, or affiliation;
• Use the Service to solicit money, financial details, investments, cryptocurrency transfers, or gifts through deception or fraud;
• Promote illegal commercial sexual services or use the Service to facilitate exploitation;
• Send unsolicited spam, operate unauthorized bots, scrape profiles, or conduct unauthorized advertising or recruitment;
• Share another member's private or identifying information without authorization or a lawful basis;
• Interfere with the Service, evade moderation, or circumvent security measures; or
• Use the Service for conduct that violates applicable law or a valid legal restriction.

We may review reports and take action where appropriate, including removing content, issuing warnings, restricting features, suspending accounts, or terminating access. Actions will depend on the circumstances, the available information, our policies, and applicable law. We may refer matters to the appropriate authorities where warranted or legally required.

05 Your content

You retain ownership of the content you submit to the Service, such as profile information, photos, prompts, and messages, subject to any third-party rights that apply.

To operate and provide the Service, you grant Match Vibe Fusion a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, adapt for technical purposes, and display your content as reasonably necessary to make the features you use available. This may include displaying profile content to other members according to your settings and the Service's functionality.

This license ends when your content is deleted or your account is closed, except to the extent content remains available to recipients who previously received or saved it, is retained in routine backups for a limited period, is needed to resolve disputes or enforce our Terms, or must be retained under applicable law.

You represent that you have the rights and permissions needed to submit your content and that your submission does not unlawfully infringe another person's rights or violate applicable law.

Do not post information you are not comfortable sharing with the audience permitted to view it. Other members may copy, capture, or retain information they can access.

06 Subscriptions & billing

Some Service features may be available at no charge. If paid plans, including Plus or Forever, are offered, the applicable plan details, features, price, and billing interval will be presented before purchase.

• Pricing: The price and currency shown at checkout apply to your purchase. Applicable taxes and additional charges will be disclosed where required.
• Automatic renewal: If a subscription is set to renew automatically, it will renew for the disclosed billing period unless you cancel before renewal under the applicable cancellation instructions.
• Payment authorization: By purchasing a subscription, you authorize the applicable payment provider to process the disclosed charges using your selected payment method.
• Payment failures: If a payment fails or is reversed, we may request updated payment information or restrict paid features, subject to applicable law and the terms of the payment provider.
• Third-party purchases: Subscriptions purchased through an app store or other third-party platform may be subject to that provider's billing, renewal, and cancellation terms.
• Price changes: Any subscription price change will be communicated and implemented in accordance with applicable law and any notice or consent requirements that apply.

Cancel using the account settings or the billing platform through which you purchased the subscription, following the instructions provided there. Unless applicable law or the purchase terms provide otherwise, cancellation generally takes effect at the end of the current paid billing period. Cancelling a subscription does not automatically delete your account or profile.

Review the checkout details carefully before purchasing, including the renewal frequency, total price, and cancellation method.

07 Cancellation & refunds

Cancellation stops future renewals when completed in accordance with the applicable cancellation process. Unless required by law or stated in the terms shown at purchase, cancelling does not automatically refund charges already paid or unused time in a billing period.

Any refund policy specifically presented during checkout or in the applicable purchase terms will apply to the extent permitted by law. To ask about a charge, request a refund, or report a billing issue, contact contact@matchvibefusion.info and include relevant purchase details without sending full payment-card information.

Refund eligibility may depend on the purchase channel, the timing and circumstances of the request, and applicable law. Purchases through Apple, Google, or another third-party provider may need to be handled through that provider.

Nothing in these Terms limits a refund, cancellation, or withdrawal right that applies to you under mandatory law.

08 Safety & no guarantees

Match Vibe Fusion is a platform intended to help people discover and communicate with one another. Unless expressly stated for a particular feature, we do not independently verify every profile, statement, image, or claim made by members, and we do not guarantee that profile information is accurate or complete.

We do not promise that every member is genuine, suitable, safe, or compatible with you. Do not assume that a profile, conversation, or any information provided by another member has been verified by us.

Use sound judgment when interacting with others. Consider meeting in a public place, telling someone you trust about your plans, arranging your own transportation, protecting personal information, and never sending money to someone you have not independently verified.

To the extent permitted by law, you are responsible for your decisions and interactions with other members. Nothing in this section excludes liability or duties that cannot legally be excluded.

09 Intellectual property

The Service's software, design, branding, logos, text, and other materials provided by Match Vibe Fusion are owned by or licensed to us and may be protected by copyright, trademark, and other intellectual property laws.

Except as permitted by law or expressly authorized by us in writing, you may not copy, modify, distribute, publicly display, reverse-engineer, or create derivative works from our materials or the Service. This restriction does not override rights that applicable law grants you.

You may not use our name, trademarks, logos, or branding in a way that suggests sponsorship or endorsement without prior written permission.

If you believe content on the Service infringes your intellectual property rights, contact contact@matchvibefusion.info with enough information for us to understand and review your concern.

10 Suspension & termination

You may stop using the Service at any time. If account deletion is available in your account settings, you may use that process to request deletion. You may also contact contact@matchvibefusion.info for assistance. Data handling after closure is described in our Privacy Policy.

We may restrict, suspend, or terminate access when reasonably necessary to enforce these Terms, protect members or the Service, address suspected fraud or abuse, comply with law, or respond to other legitimate operational or safety concerns. Where appropriate and lawful, we may provide an explanation and an opportunity to appeal by contacting us.

If we discontinue a paid feature or terminate a paid account for reasons unrelated to your breach, any refund for prepaid unused subscription time will be handled according to the applicable purchase terms and law.

Closing an account does not eliminate obligations or liabilities that arose before closure, nor does it require us to retain information longer than permitted or required by law.

11 Disclaimers

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will always be available, uninterrupted, secure, error-free, or compatible with every device, or that use of the Service will result in a particular outcome or relationship.

To the extent permitted by law, we disclaim warranties that may otherwise be implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The scope of these disclaimers depends on applicable law.

Nothing in these Terms excludes a warranty, consumer guarantee, or other protection that cannot lawfully be excluded or limited.

12 Limitation of liability

To the maximum extent permitted by applicable law, Match Vibe Fusion will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from or relating to your use of the Service, where those exclusions are legally enforceable.

To the maximum extent permitted by law, our aggregate liability for claims arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid us for the Service during the 12 months before the event giving rise to the claim or USD 100.

These limitations apply only to the extent permitted by applicable law. They do not exclude or limit liability that cannot lawfully be excluded or limited, including any non-waivable rights or remedies available to you under applicable consumer protection laws.

13 Governing law & disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules, except where applicable law requires another law to apply.

Subject to applicable law, disputes relating to these Terms or the Service may be brought in the state or federal courts located in Delaware. This provision does not prevent consumers from bringing claims in another court when applicable law gives them that right.

Before pursuing a formal claim, you may contact us at contact@matchvibefusion.info so we can try to resolve the issue informally. This request does not shorten or waive any applicable filing deadline or legal right.

14 Changes to these terms

We may revise these Terms to reflect changes to the Service, our practices, or applicable law. We will update the date shown at the top when revisions take effect and provide additional notice or obtain consent when required by law.

Where appropriate, we may notify you through the Service or by email using the address associated with your account. The timing and method of notice may depend on the nature of the change and applicable legal requirements.

If you do not agree to revised Terms, you should stop using the Service and may close your account. Continued use after revised Terms take effect may indicate acceptance where permitted by applicable law.
